Who this is between

These terms are between you (the visitor) and Ian DeFelice, a licensed real estate professional in Indiana (RB19001857), affiliated with Roots Realty Co. and @properties (RC51100159). The site itself is built and operated by Jarred Porter / Tuscan Agency on Ian's behalf.

By using the site, you agree to this

Browsing defelicehomes.com, submitting the quiz or contact form, or signing up for the digest means you've read and agree to these terms. If you don't agree, please don't use the site.

What you can do here

• Read everything.
• Take the quiz and get your starting plan.
• Reach out via the contact form, email, or DM.
• Sign up for the digest (and unsubscribe whenever).
• Share links to public pages with people you think would benefit.

What you can't do here

• Scrape, crawl, or systematically harvest the site (beyond standard search-engine indexing). The robots.txt and sitemap.xml define what's open.
• Try to break authentication, rate limits, or any security feature.
• Submit false information through the forms (especially someone else's contact info).
• Use the site to send spam or unsolicited messages back through the contact form.

The market data and neighborhood content on this site is sourced from MIBOR, public records, and Ian's first-hand experience. It is current as of the dates shown but markets change. Don't make a bid based on a number you read on a blog post six months ago.

By submitting your name, email, phone, or any other information through a form on this site, you confirm:

• The information is yours, or you have permission to share it.

Content and intellectual property

The writing, photos, design, and structure of this site belong to Ian DeFelice and Tuscan Agency, except where third-party content is clearly attributed. You can quote short excerpts with attribution and a link back. You cannot copy the site wholesale, republish blog posts in full, or use the design/code as a template for another site without written permission.

Your submissions (quiz answers, contact messages) remain yours. By submitting, you grant me a license to use them internally to respond to you and to anonymize them for aggregate analysis. I won't quote you publicly without your permission.

Links to other sites

I sometimes link to lenders, attorneys, partners, neighborhoods, and outside articles. I don't control those sites and I'm not responsible for what they do or say. A link is not an endorsement of every page on the destination site.

No guarantee

Limitation of liability

To the fullest extent allowed by Indiana law, Ian DeFelice, Roots Realty Co., @properties, and Tuscan Agency are not liable for indirect, incidental, consequential, or punitive damages arising from your use of this site. If a court finds that some liability applies, the total liability is limited to $100 or the amount you paid to use the site (which is zero), whichever is greater.

You'll cover us if you misuse the site

If your misuse of the site (a violation of these terms, a misrepresentation in a form submission, etc.) causes a legal claim against Ian, Tuscan Agency, or the brokerage, you agree to cover reasonable costs of defending against that claim.

Indiana law applies

These terms are governed by the laws of the State of Indiana, without regard to conflict-of-laws principles. Any dispute that can't be resolved by talking it through goes to a state or federal court located in Marion County, Indiana.

If something changes

If I update these terms, the "Last updated" date at the top changes. Continued use of the site after a change means you accept the updated terms.
